This is logical:
1. I buy land. I might use my land. If I loose land claim - I can't using that land anymore. But if I still have a cliam - this land is still mine. If not - it's exploit or illogical feature.
2. If anybody can claim town over my land and then open my LOCKED gate for gree - it's exploit or illogical feature.
If this an exploit - I need compensation, it'd fair. If in my case this features I don't like it and I that why I might leave this game, I like most logical and transparent game mechanic.

anyways, this is indeed how the game works.
you buy land for your own usage, but if someone wants to build a town over your claim, town claim beats personal claims and can declaim them. (would cost them silver for declaiming.)
some diplomatic people may try to talk before doing it, but its not that easy with time-zone difference.
if you do not want your claim taken away like that, you need to build your own town over your claim.
having your claim but not building your town or not belonging to a town always has this risk.
also, anyone can smash your gates with high enough humours no matter claimed or not, its not an exploit nor illogical feature.
if you dont like it, you can
1) leave the game,
2) get over it and resettle somewhere else,
3) hire a mercenary or offer a bounty to destroy the town for revenge.
