Unpayed Claims - Cant enter until totally Despawn stake?

Found what looks to be a abanded claim - I assume the freebee credit time is used up by now ..

And was wondering can you not enter the claim until its stake stone is totally despawn?

As of right now claims require upkeep to the tune of 4s + (Claimed Area / 300)s per day. If the upkeep is not paid, the claim is turned off and the stone itself becomes possible to destroy. You can charge the claim with enough silver to last 2 months. Previously existing claims will be charged to last one month.

It should be possible to enter the claim and do stuff on it like it wasn't even there. But this was implemented on 2nd of December, so the freebie upkeep hasn't been depleted yet.
