Legally he was justified in the killing of that man. Sorry, but if you charge at someone you tower-over in the United States of America, and they just so happen to be armed, you are liable to be shot, and/or killed thereof the injury, even if you were lenient on not doing so the first time they beat you. Race, creed, and-so-on and-so-forth do not factor into this; yet if they do then consult that State's laws on hate-crimes.

Sorry but the guy did have it coming due to his first action. He was lucky not to be gunned down while beating the officer the first time; as other armed individuals may have.
