Yes, if there's no claim on it, or if there is a claim but you can walk on it without turning crimes on (because the claimstone ran out of silver), it's anyone's to claim or loot. If you like it, take it over.

Just be sure the homestead you set up goes all the way to the walls or those walls won't keep anyone out.
Edit: If you find a claim that is still there but ran out of silver, I think you have to destroy the old claim stone before you can make your own.

there are several ways to earn silver ingame, but for a newb (no offence) with little game knowledge or experience it can seem quite tedious.
I suggest rushing Indian tracking, so you can start to find feathers and make savage charms, which sell to the NPC stalls for 35 silver each..
After this there is cricket teams which sell for 40s each.
Also you can gather + sell items to players, good items which many buy are, hay, singing logs, tumbleweeds, and honey dew, All these items sell quite well.
Hope this helps.
Your image of a small start place seems enticing, but i would strongly suggest you first go into a forest and try to find a place to live in a forest or very close to one, as you will spend most of your time ingame, in or around a forest, and if you do not have a forest close by, at mid>end game, you will be royally *****.

Don't forget hollow stubs. They sometimes contain nice gifts (snake hides).

Another way of getting silver is getting carpentry and making wood piles (they need to be away from any unmovable object like trees or walls by at least 5 tiles) - many people will buy dry boards at good price.
As for location the specific biome isn't that terribly important, although settling at a boarder of 2 or more different ones helps. What you will need later on are lots of trees and perhaps even more easy access to a lime quarry.
