Is there a way to see if a criminal is dead?

I got robbed recently. This pissed me off, so I went out to look for the one responsible. The character was offline and I only got an arrow to where his claim was. I tried to find his claim for several hours, but it was too far out so gave up eventually. I went to town to put the criminal in the stockades. Paid the 500 silver, walked to the stockades only to get the message: this character is dead.

My question: Is there a way to find out about this before hand? Kind of sucks to have wasted so much time and 500 silver..

Select the evidence and right click it on the ground, if it does not give you the notice: perparator is dead, it is not dead and still lives.
