Rightclick the stocks that is holding the player. It will bring up the classic flower menu which will allow you to whip the criminal.

Is it possible to get diseases from the criminal in whip-distance?

there is a chance to get a disease by simply being close to diseased players, so id say yes

If you would like to whip these criminals without the fear of getting a disease, you need to invest in Plague Doctor's Masque. This mask will make you immune to "Airborne" Disease, from criminals or other people coughing on you. It does however cost a whoppin 700 Silver though, but well worth not getting diseased while whipping or shopping.

*This mask will not protect you from disease from rats*

To anyone reading this, please keep in mind that the regular Plague Mask is not 100% safe from airborne diseases. There is still a small chance that you might get sick, how big of a chance that is though, I am not sure.
There is however a special mask available in one of the shop packs that provides 100% immunity from airborne diseases.
