My friend and I built a base in woods, after some time near us settled thief. I destroyed his homestead. After few days I am log into the game and see my char in stocks. Why and how? The fence is not broken.

U got put in the stocks, that's not being dead.

You can however die in the stocks if you don't have protection against diseases and witches.

Don't do crimes if you can't handle it...
