So my brother was trespassing and ran out of bile. he is knocked out and the timer shows 14 days?

so what can he do to get out? seems bit harsh to lose game for two weeks do to few moments of trespassing on others land when he has not even murdered anyone

The time he will be stuck on the claim for different duration of time depending on how many crimes he committed. The top end of that is only 24 hours though. It sounds like if he has 14 crimes then he will be stuck there the full 24 hours, and his crimes will stay a full 14 days.

P.S.
Tell your brother to stop being a criminal.

So taking stuff from abandoned places where people have quit the game counts up to overall crime?

Depends how long ago they quit, if there's still silver in their claim then it's a crime. No silver, no crimes. (you can tell when you try to interact with objects with criminal acts off, it says the land belongs to them. If it doesn't say that then you don't need to turn on criminal acts and you don't need to leave scents for borrowing stuff)

As for getting off the claim, you could try and bribe carver to reset the server for a bugfix to get a free port out early minus the contents of your inventory ofc :D
(this is intentional, right? ...not that I've been doing this... probably...)

You did not know you could bribe the dev/report a huge bug to get a free port off an enemy claim?

I might have liberated some items that otherwise would have decayed because my other neighbors were too sheepish to approach closely or too incurious to actually find the claim while also still being close enough to activate the cell the claim was in. Some of it was actually fairly decent stuff.
