If the area was clay then he wouldn't really be able to flatten it. If the area wasn't flat then he would get different message ("the area is not flat enough").
He is trying to build on unpaved forest terrain.

its a clay pit and no cant pave it..i was able to flatten around the some what flat area .. and pretty nice for a mod to talk crazy about its players. Think im done with this game have spent enough time on it just to be able to build anything on it and to have a mod that is usless for help but instead wants to make fun of new players as they make mistakes

ya insteaed of offering a solution and answering how i can contact the devs as nothing is labled CANT BUILD ON would like to at least get my silver back so i can move somewhere else ill give up the time i took gettin the area ready no big deal

Uhm, he offered you a solution, twice. You can try contacting devs through PM or on IRC, but most likely they would ignore you because...

1. They don't handle reimbursements.
2. Bugs should be reported in bugs section or on bugtracker, but this case has been proven to not be a bug.
3. This is beta and many features (including UI, descriptions, tutorials) are still in development.

If you need silver back then contact TotalyMoo on forum, or paradox's support (mail was around the forum somewhere) about it. But it will work only with silver you bought for real money.

You can have only 1 claim per character, afetr declaiming you don't get silver back

You can have as many claims as you desire, otherwise, Procne is correct on silver refunds.

I am sure you can have as many claims as you want. If there is a cap on how many you can have, I've never reached it.
