So I'm also having the problem you cannot build that there. Are only certain things able to be built under a pclaim or town claim? If so which items? Maybe it is a footprint thing, if so anyone have the correct dimensions of a ore smelter and bread oven? Thanks in advance.

Usually this error occurs when you try building stuff over grass / forest ground. Turn it into dirt or pave it first.
Also make sure you are not trying to build over clay / stone.

This was exactly what it was, forest ground had grown over the flat land. Thank You.
