It belongs to whoever bought the writ unless it's been changed. (If it has, it wasn't announced.) It has been one quite common complaint of the game.) You'll know who owns it for sure by who can manage it. Otherwise, anyone in the party has rights to do anything on a claim if they are in a party with the owner. They just can't manage the stone.
To get rid of that lean-to, just expand over it. It is then "yours" and can be destroyed without black skills or leaving scents. If it hasn't been flagged as a homestead, it doesn't matter and anyone can destroy it.
