Sec. 5b.
(1) Except as provided in subsection (2), a person who is detained or incapacitated within Tribal lands shall have the opportunity to protest detention. A person in defense of wrongful detention shall provide receipt of treaty payment and/or other proof of collateral.
(2) A person who has filled a Treaty Exemption form and is detained or incapacitated within Tribal lands shall have the opportunity to protest detention. The defense of a person in wrongful detention must be completed by the Tribal Representative named on the T.E. Form. Power of attorney shall be given to the Tribal Representative in an effort to complete the defense of said person.
