Them actually claiming they're in commercial open release, not quite check. Funny enough, after my mates went on break due to the recent patches, I started playing a bit of Path of Exile. You need no key to play it, content access is limitless, and they also have a cash shop. And just like Salem that game is in open beta :P Weird stuff eh? How a game can never claim to release and still have a part of the playerbase, if a small one, be in denial about the development stage the game is in. That's like the doctor telling a pregnant woman she already gave birth, and just doesn't know it.

I don't remember the thread, but it was stated by TotalyMoo quite some time ago that that Q1 2013 date is wrong and needs to be updated. We're still in beta, not released.

No Key required. Check
No limited access. Check
Cash shop in place and open for months to spend $$$. Check

This small list of items here shows this game is in COMMERCIAL OPEN RELEASE, with a beta tag attached like every other game do now days so they can totally break the system / ***** you over, and have a legal back fall.

Say what you will but its still beta. get over it.

It is beta by name only, content and mechanic are at alpha state. Balancing, nerfing, some other small changes are ok even after 1.0 release, but redesigning basic game mechanic is very rare in beta it happens mostly in alpha and we are still before mining redesign (I hope) and before witchcrafting (basic game feature?).

You mean that after 1.0 release dev team is working on huge addon it adds new content and changes basic game mechanics too, but you must pay for it like for new game?

It still changes the mechanics for everyone, including the people that choose to opt out of purchasing an expansion, regardless of the game being already released, or of the fact that players had paid for the game during the old set of mechanics.

If it's really beta, I should be able to get my money back, right ? From a legal point of view ? ¦] ¦] ¦] ¦]

why would you assume that? I'm quite sure that Paradox has the standard boiler plate eula.
I have neither the crayons nor the time to explain it to you.
