Not a bug, you just don't understand the game mechanics. Should of got the silver from him and bought your own claim.
It's his settlement but when you are not in a party with him then you are a criminal in the game eye because he has not given you permission to be there. He can't TP, the only option is for him to run out there and send you home or get killed and inherit his claim. If none of that goes down you got to wait 24 hours.
